These are the terms of use for Vesper ("the app"), an iOS app published by Lars Holmstrom, operating as a sole trader in Melbourne, Australia (ABN: 58 778 326 834) ("we", "us", "our").
By downloading or using Vesper, you agree to these terms. If you don't agree, please don't use the app.
What Vesper is
Vesper is a contemplative scripture and spiritual practice app for iOS. It includes Bible translations, cross-references, commentary excerpts, reading plans, and journaling features. Most of the app is free; some features require a paid subscription.
Your account (or lack thereof)
Vesper doesn't have user accounts. You don't sign up, you don't give us an email. Your data lives on your device. This means:
- We can't recover your journal entries or reading history if you lose your device or uninstall the app — back up your iPhone if that data matters to you.
- iCloud Backup (if enabled in iOS settings) is the only way your data syncs across devices, and that's handled by Apple.
Subscriptions and billing
How it works
Vesper offers two paid subscription options through Apple's App Store:
- Weekly: US$1.99 per week
- Yearly: US$29.99 per year
A 7-day free trial is available for new subscribers. Pricing in your local currency is shown on the paywall before you subscribe.
Auto-renewal
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Apple charges your Apple ID account for the renewal at the same price you originally paid.
Free trial
If you start a free trial and don't cancel before it ends, you'll be charged for the subscription at the price shown when you signed up. To avoid being charged, cancel at least 24 hours before the trial ends.
Managing or cancelling
All subscription management is handled by Apple, not by us. Go to Settings → [Your Name] → Subscriptions on your iPhone. You can cancel any time, and you'll keep access until the end of the current paid period.
Refunds
We don't process refunds — Apple does. Request refunds through Apple at https://reportaproblem.apple.com.
If you're in Australia, nothing in these terms excludes the consumer guarantees you have under the Australian Consumer Law, including the right to a refund for major failures.
Acceptable use
Vesper is for personal, non-commercial use. Don't:
- Reverse engineer, decompile, or try to extract source code from the app
- Use the app or its content to build a competing product
- Bulk-export the bundled scripture, commentary, or reading plan content for redistribution
- Use the app in any way that violates Australian law or the law of your country
Content and licensing
Vesper bundles the following scripture and reference content:
- World English Bible (WEB) — public domain
- King James Version (KJV) — public domain
- Reina-Valera 1909 — public domain
- Almeida Revista e Corrigida (ARC) — public domain
- Riveduta (1924) — public domain
- Strong's Concordance entries — public domain
- Matthew Henry's Commentary excerpts — public domain
- Cross-references — derived from public domain sources
Reading plan content, journaling prompts, original UI text, photography, and the app itself are © Lars Holmstrom. All rights reserved.
You can use the bundled scripture content for your personal study and quote it as you would any other Bible. You can't extract the database, scrape the app, or republish bulk content.
Subjective content disclaimer
Vesper is a tool for spiritual practice. It's not pastoral counselling, theological instruction, or a substitute for professional mental health support. Commentary excerpts and reading plans are provided for reflection and shouldn't be treated as medical, psychological, legal, or financial advice. If you're in crisis, please reach out to a qualified professional or a crisis service in your country.
"As is"
The app is provided "as is" and "as available". We try hard to make it work well, but:
- We don't guarantee the app will be uninterrupted, error-free, or compatible with every device
- We don't guarantee the accuracy of every cross-reference or commentary excerpt
- We're not responsible for any loss of data caused by uninstalling the app, iCloud sync issues, or device failure
To the maximum extent permitted by law, we exclude all implied warranties. Nothing in these terms excludes any rights you have under the Australian Consumer Law or other non-excludable consumer protection legislation that applies to you.
Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim relating to Vesper is limited to the amount you've paid us for the app in the 12 months before the claim arose. We're not liable for indirect, incidental, or consequential losses.
This limitation doesn't apply where it would be unlawful — for example, it doesn't limit liability for death, personal injury caused by negligence, fraud, or any rights under the Australian Consumer Law that can't be excluded.
Changes to the app
We may add, change, or remove features at any time. We may also discontinue the app entirely. If we discontinue the app and you have an active paid subscription, we'll work with Apple to issue a pro-rata refund where applicable.
Changes to these terms
If we change these terms, we'll update the "Last updated" date and post a notice in the app or on the website. Continued use after a change means you accept the updated terms.
Termination
You can stop using Vesper at any time by deleting it. We may terminate your access if you breach these terms — for example, by trying to reverse engineer the app or extract its content for redistribution.
Governing law
These terms are governed by the laws of Victoria, Australia. Any dispute will be handled by the courts of Victoria, Australia, unless mandatory consumer protection law in your country requires otherwise.
Apple-specific terms
Vesper is distributed through the Apple App Store. You acknowledge:
- These terms are between you and us, not you and Apple. Apple isn't responsible for the app or any claims relating to it.
- Apple has no obligation to provide support for the app.
- If the app fails to conform to any applicable warranty, you can notify Apple and Apple will refund the purchase price (if any). Beyond that, Apple has no warranty obligation.
- Apple is a third-party beneficiary of these terms and may enforce them against you.
